OTR Load Board Inc. (“OTR,” “Company,” “we,” “us,” or “our”) respects the privacy of our users and is committed to protecting personal and business information processed through the OTR Load Board platform (the “Platform”). This Privacy Policy explains how we collect, use, disclose, store, and protect information when you access or use our Platform, website, APIs, and related services.

This Privacy Policy is incorporated by reference into the OTR Load Board Master Subscription, Services & Platform Access Agreement.
1. Scope Applicability

This Privacy Policy applies to:

  • Brokers, carriers, shippers, dispatchers, and logistics professionals
  • Authorized users of Starter, Professional, and Enterprise subscriptions
  • API users and integration partners
  • Website visitors and applicants

This Policy does not apply to transactions conducted off-platform or to third-party services not controlled by OTR.

  • OTR Load Board Inc.: Data Processor (and Data Controller for Platform Data)

Clients retain ownership of their business data. OTR controls Platform-generated and aggregated data.

3. Information We Collect Collection

3.1 Information You Provide

  • Account registration data (name, email, phone)
  • Business information (company name, address, EIN, MC/DOT numbers)
  • Identity verification documents (government ID, insurance, authority documents)
  • Load postings, truck postings, documents, and communications
  • Payment and billing information (processed via third-party processors)

3.2 Information We Collect Automatically

  • IP address and geolocation data
  • Device identifiers, browser type, operating system
  • Login history, session data, timestamps
  • Usage data, clicks, searches, postings, and interactions
  • API logs and request metadata

3.3 Platform & Derived Data

  • Fraud risk scores
  • Matching and ranking outputs
  • Aggregated marketplace analytics
  • Behavioral and performance analytics
  • System logs and audit records
4. How We Use Information Processing

We process information to:

  • Create and manage accounts
  • Verify identity (KYC/KYB)
  • Enable load and truck postings
  • Facilitate marketplace search and matching
  • Prevent fraud, abuse, and market manipulation
  • Monitor compliance with Acceptable Use Policy
  • Improve platform performance and features
  • Provide customer support
  • Process payments and billing
  • Comply with legal and regulatory obligations
5. Fraud Prevention & Monitoring Security

OTR uses automated and manual systems to detect and prevent freight fraud and double brokering, identity spoofing, fake loads or equipment, unauthorized access, and platform abuse.

This may include behavioral analysis, document verification, biometric or video verification (where legally permitted), IP/device fingerprinting, and ongoing account monitoring.

6. Data Sharing & Disclosure Disclosure

6.1 Service Providers / Sub-Processors

We may share information with service providers and sub-processors such as:

  • Cloud hosting providers
  • Identity verification vendors
  • Payment processors
  • Email, SMS, and communication providers
  • Analytics and security vendors

6.2 Legal & Regulatory Disclosures

We may disclose information when required to comply with law, subpoena, or court order; respond to law enforcement or regulatory requests (including the FMCSA and other transportation regulators); enforce our agreements; or protect the safety, rights, or property of OTR or users.

6.3 Fraud Investigations

Where appropriate, we may share relevant information with law enforcement or regulators in connection with suspected fraud, including freight fraud, identity spoofing, or double brokering.

6.4 Business Transfers

In the event of a merger, acquisition, financing, or sale of assets, data may be transferred as part of the transaction. OTR does not sell personal data.

7. International Data Transfers Transfers

Data may be processed or stored in the United States and other jurisdictions where our service providers operate. By using the Platform, you consent to such transfers.

8. Data Retention Retention
  • Active accounts: data retained while account remains active
  • Terminated accounts: data retained for 90 days, then deleted or anonymized
  • Fraud, legal, or compliance data may be retained longer as required by law (including legal holds and fraud investigations)

8.1 Data Export

You may request data export during an active subscription or within the 90-day retention window. Data export requests must be reasonable, feasible, and within legal boundaries, and OTR may charge a data export fee. API-based exports may require an active API subscription and may be unavailable after cancellation. System logs and audit records may be retained for a minimum of one (1) year, and longer if required for fraud or legal actions.

9. Data Security Safeguards

OTR implements administrative, technical, and physical safeguards, including:

  • Access controls and role-based permissions
  • Encryption in transit and at rest (where applicable)
  • Monitoring, logging, and intrusion detection
  • Secure API authentication

No system is 100% secure. Users are responsible for protecting their credentials and devices.

10. Your Rights (U.S. & International) Rights

Depending on jurisdiction, you may have rights to access, correct, delete, restrict processing, and receive a copy of your data. Requests may be denied where compliance would violate law, compromise fraud prevention or security, or interfere with legal obligations.

11. California Privacy Rights (CCPA/CPRA) California

California residents have the right to know what personal information is collected, request deletion, opt out of selling or sharing (OTR does not sell data), and not be discriminated against for exercising privacy rights. Authorized agent requests require verification.

12. Cookies & Tracking Cookies

We use cookies and similar technologies for authentication, security, analytics, and platform functionality. Disabling cookies may affect Platform functionality.

13. Children’s Privacy Minors

The Platform is not intended for individuals under 18. We do not knowingly collect data from minors.

14. Third-Party Links External

The Platform may link to third-party sites. OTR is not responsible for their privacy practices.

15. Changes to This Policy Updates

We may update this Privacy Policy at any time. Updates will be posted on the Platform and/or communicated electronically, including via email, Platform notices, account dashboard notifications, or website posting. Continued use constitutes acceptance.
